WHAT TYPE OF VISA DO YOU PROCESS?

EWS processes both EB-2 and EB-3 Employment Based Visas. These are commonly called ‘Green Card’ visas.
EB-2 for Physical Therapists and EB-3 for Nurses (Green Card/Permanent Residency). The Hospital will sponsor you and your immediate family members to become legal permanent US residents (Green Cards). This will allow you, your spouse and your children under the age of 21 to legally live and work in America. This means you have PERMANENT US RESIDENCY.

WHAT IS AN EB-2 VISA?
You may be eligible for an employment-based, second preference visa if you are a member of the professions holding an advanced degree or its equivalent, or a an alien who has exceptional ability.

WHAT IS AN EB-3 VISA?

EB-3 visas are permanent residency visas(Green Card) meaning that you can remain living and working in the USA indefinitely – even after you have completed your contract with employer. If you are a Registered Nurse the hospital will be able to sponsor you on the EB-3 (Permanent Residency) visa.
The EB-3 visa brings more security for families looking to set up home in the USA. A major benefit is your spouse and dependent children (up to 21 years old) will be able to work and attend school in the USA allowing you all to start building solid foundations for your future in the USA.

WHAT IS THE RATE OF PAY?

Pay rates are competitive and based on local prevailing wage as determined by the US Department of Labor (DOL). An Employer may offer more than the local prevailing wage, but cannot pay you less. (See Question below on how the EB-3 process works)

WILL I BE OFFERED OR RECEIVE ANY OTHER BENEFITS?

As an employee of the hospital, you will receive all employee benefits offered including vacation, sick leave, retirement plans, health, dental, career development, holiday pay, etc.

WHO PAYS FOR MY FEES?

EWS SERVICES are FREE to applicants.

EWS and/or the hospital will pay the candidates immigration attorney fees, visa processing, NVC invoice and air fare to the US, and first 2 months of housing once in the US. All dependent fees are the cost of the candidates.

WHAT IS PREMIUM PROCESSING?

Premium Processing Service provides expedited processing for certain employment-based petitions and applications. Specifically, USCIS guarantees 15 calendar day processing to those petitioners or applicants who choose to use this service. Your sponsor may or may not offer this service.

IS THERE A COST FOR MY SPOUSE AND CHILDREN?
Yes, you will need to pay the required NVC fee per dependent as well as an attorney fee for each dependent. There are also medical and background check fees per dependent. EWS pays only the candidates NVC and attorney fees.
HOW LONG DOES IT TAKE TO PROCESS MY EMPLOYMENT BASED (EB2 OR EB3) VISA APPLICATION ONCE IT BEGINS?
Submitting your complete documents to the attorney will begin the process. Other requirements for an Employment Based Visa (EB) is the Employer has to post a “Notice of Filing”. At the same time, the Department of Labor has to complete a “Prevailing Wage Determination (PWD)”. This part of the process alone can take up to 5 months. Then your I-140 is submitted and you will receive a Priority Date (PD). The US Visa Bulletin with Priority Dates is released monthly. Normal processing for the I-140 is determined by PD and could take up to another 6 months. I HAVE AN ABANDONED EMPLOYMENT BASED (EB) VISA FROM ANOTHER SPONSOR. CAN I USE THAT VISA AND NOT LOSE MY PRIORITY DATE?
EWS can also help healthcare professionals who have been abandoned by a previous sponsor. You may be able to have a new I-140 filed to recapture the Priority Date from your original petition so you do not have to go to the back of the waiting line.
Before agreeing to have a new employer file a new I-140 petition on your behalf, you should make sure you have been released from any contractual obligations from a prior employer who previously filed an immigrant petition on their behalf, or to an agency they worked with. You should have proof in writing that you have been released from any obligations.
Can I Transfer the I-140 Petition to a New Employer or Job?

An approved I-140 is usually employer and job-specific. An I-140 typically can be used only to apply for lawful permanent residency (i.e. a “green card”) with the petitioning employer. In fact, the I-140 petition generally cannot even be used for a new position with the same employer that filed the I-140. Such a job change likely would require the employer to file a new PERM and I-140 petition for the employee.

Can the Petitioner Revoke My Approved I-140?
Ordinarily, the I-140 petitioning employer may send a withdrawal notice to the U.S. Citizenship and Immigration Services (USCIS) at any time. However, once 180 days have passed following approval of the I-140 petition, the USCIS will not revoke the I-140 petition solely based on the petitioner’s request for the withdrawal of the petition.
If the USCIS receives the employer’s withdrawal request within 180 days of the I-140 petition approval, the USCIS will revoke the approved I-140. In this situation, the employee / beneficiary still gets to retain the priority date, unless the revocation was determined to be due to fraud, willful misrepresentation or material error by the USCIS, or the underlying labor certification was invalid or revoked.
HOW DO I KNOW MY I-140 WAS APPROVED?

You will receive an email with your approval and Priority Date (PD).

WHAT HAPPENS AFTER I RECEIVE MY I-140 APPROVAL EMAIL?

Your file will be sent to the National Visa Center (NVC) which is part of the Department of State (DOS). When your PD is current, the NVC will contact you with additional instructions.

WHAT DO I NEED TO PREPARE BEFORE THE NVC CONTACTS ME?

You need to obtain your IELTS and Visa Screen. You can go to www.cgfns.com for instructions and costs.

WHAT IS THE NVC PROCESS?
ARE THERE ANY OTHER FORMS TO BE FILLED OUT?

WHAT ABOUT MY SPOUSE AND CHILDREN? DO THEY HAVE TO FILL OUT ANY ADDITIONAL PAPERWORK
Your spouse and children can be filed with your NVC application, as they were part of your I-140 application. They will also need to have a medical exam, background check and embassy interview. However, they do not need to interview until they are ready to deploy to the US.

MY NURSE LICENSE IS NOT ENDORSED TO THE STATE I AM BEING HIRED IN. HOW DO I ENDORSE MY NURSE LICENSE TO THE PROPER STATE?

EWS will assist you in endorsing your U.S. Nursing License to the proper state once you have passed your NVC interview.

I NEED A SOCIAL SECURITY NUMBER TO WORK IN THE US. HOW DO I APPLY FOR ONE?
Before attending the U.S. Embassy interview, you will complete the form DS 260. On the form you will apply to receive your social security card in the U.S.

IS EWS A STAFFING COMPANY OR PLACEMENT COMPANY?

EWS is a Healthcare Placement Company for healthcare positions in hospitals throughout the United States.

WHO IS MY EMPLOYER?

You will work DIRECTLY for the Hospitals in Full Time Permanent Positions. EWS is a Placement Company and You are NOT EMPLOYED by EWS.

IS THERE A CONTRACT OR COMMITMENT TIME WITH EWS?

Since you are hired directly by the hospital, there is no contract or commitment with EWS. However, you will be required to commit to the hospital for a specific time period, generally 3 years.

DOES EWS ASSIST ME WITH THE INTERVIEW OF MY POTENTIAL EMPLOYER?

EWS is with you every step of the way. We will schedule your interview and coach you throughout the entire process from initial application & interview, through the visa process, all the way until you land in the USA and beyond.

WHAT CAN I EXPECT AFTER I APPLY? WHAT IS THE HIRING PROCESS?

  1. Our Local Partner Agency will collect and check all your documents, then contact you for a pre-screen interview.
  2. After you pass the pre-screen interview, your application form will be sent to the EWS office for a 2nd review. Finally EWS will send your CV to the hospital for final review. The hospital will schedule your interview via Skype or other agreed to communication.
  3. Once you pass the interview, you will sign an Employment Agreement (EA) with the hospital.

Now the Immigration Process begins. The hospital’s immigration lawyeralong with EWSwill gather your documents to file an I-140 application for an EB-2 or EB-3 visa.

DOES MY NCLEX EXPIRE?
No. Once you take the test and pass, you are all set. You do not have to retake the test. Even though it may show online as expired, when you submit your state nursing license, it will be renewed and endorsed to the state you will be working in.
DOES MY IELTS EXPIRE? WHAT BAND SCORE DO I NEED?
Your IELTS does expire after 2 years. With the existing wait time of a visa sometimes exceeding 2 years, your IELTS may expire. However there is a way around this. Once you pass the IELTS, you should immediately get a VisaScreen certificate from the CGFNS website. A VisaScreen is valid for 5 years which extends your IELTS to 5 years. The required Overall Band Score is 6.5. Your Spoken Band Score needs to be 7.0. Is the new OET (Occupational English Test) an accepted test for the visa screen?

Yes, the new OET is an accepted English test for a visa screen. The required Overall Score is 300. Your Spoken Score needs to be 350. You can check the OET Band Score requirements at https://www.cgfns.org/services/certification/visascreen-visa-credentials-assessment/
